1. Scope of this policy
This Refund Policy applies to cancellation, withdrawal, and refund requests relating to services offered under the ArieDev brand. Specific terms in an accepted quotation, order, or contract prevail to the extent permitted by law.
This policy should be read together with the Terms and Conditions. Mandatory consumer rights cannot be excluded by contract.
2. General principles
Software development, consulting, design, integration, and technical work are typically customized services that consume reserved capacity from the moment planning and execution begin. For that reason, payments are not automatically refundable merely because the Client changes priorities, delays the project, no longer needs the work, or prefers a different solution.
Any refund is assessed against the accepted scope, work already performed, capacity reserved, non-cancellable third-party costs, deliverables provided, and any mandatory rights that apply.
3. Deposits, reserved capacity, and custom services
Deposits and initial payments reserve development capacity and may cover discovery, planning, architecture, environment preparation, research, administration, and work commenced. Once those activities or reservations have occurred, the corresponding portion is considered earned and is normally non-refundable, subject to mandatory law.
If an accepted proposal identifies an amount as a non-refundable reservation fee or otherwise allocates payment to a completed stage, that treatment applies to the maximum extent permitted by law.
Where a project is paused or terminated by the Client, the Provider may invoice work completed and committed costs before assessing whether any unused balance remains refundable.
4. Consumer withdrawal rights
If the Client is a consumer and a statutory withdrawal right applies to a distance or off-premises contract, the withdrawal period and required information are governed by applicable consumer law.
To exercise a withdrawal right, the consumer must send an unequivocal written statement through the written channel identified in the quotation, contract, or order confirmation, including sufficient information to identify the contract and the intention to withdraw.
If the consumer expressly requested that the service begin during the withdrawal period, the Provider may retain or charge the proportionate value of services performed before withdrawal where permitted by law. The right may cease after complete performance if all legal conditions for early performance and acknowledgement of loss of the right were satisfied.
5. Digital content not supplied on a tangible medium
Where the contract includes digital content supplied immediately without a tangible medium, statutory withdrawal rights may be lost after performance begins if the consumer gave the express prior consent and acknowledgement required by law and received the required confirmation.
If those legal conditions are not satisfied, mandatory consumer rights remain unaffected.
6. Cases in which a refund may be recognized
Subject to the contract and applicable law, a refund may be considered where the Provider cancels work before performing the relevant paid activity, where an undisputed duplicate payment occurred, or where a refundable unused balance remains after deducting completed work and non-cancellable costs.
If a material non-conformity falls within an express warranty and cannot be corrected within a reasonable opportunity to cure, the remedy may include repair, price reduction, or refund only where required by the agreement or mandatory law.
7. Cases normally not refundable
Unless mandatory law requires otherwise, refunds are normally not available for work already performed or accepted; time reserved and subsequently lost because of Client delay; discovery and planning; approved milestones; third-party licenses, domains, hosting, subscriptions, API fees, transaction fees, or other non-recoverable costs; change-of-mind requests; out-of-scope expectations; or issues caused by Client systems, unauthorized modifications, or external providers.
No refund is due solely because a project does not produce a particular commercial result, ranking, revenue level, conversion rate, or business outcome unless that result was expressly guaranteed in writing.
8. How to submit a request
Send the request through the written channel identified in the applicable contractual documents and clearly label it as a refund request. Include the contract or project reference, the payment concerned, the reason for the request, relevant evidence, and the remedy requested.
Incomplete requests may be put on hold until sufficient information is provided. The Provider may request reasonable evidence needed to verify identity, payment, and the contractual basis of the request.
9. Review, timing, and method of refund
Requests are reviewed on the basis of the contract, project records, payment records, work completed, and applicable law. No statement made during the review constitutes acceptance of liability.
If a refund is approved, it will normally be returned using the original payment method where reasonably possible, less any lawful deductions and non-refundable charges. Bank, card-network, processor, or currency-conversion timing is outside the Provider’s control.
Where consumer law imposes a specific refund deadline, that mandatory deadline applies.
10. Chargebacks and payment disputes
Before initiating a chargeback or payment dispute, the Client should use the contractual written channel to allow the Provider a reasonable opportunity to investigate and resolve the matter.
Initiating an unjustified chargeback does not cancel amounts legitimately due, accepted work, third-party costs, or contractual obligations. The Provider may provide contractual and project records to the payment provider and may suspend ongoing services while a payment dispute is unresolved, to the extent permitted by law.
